Sunshine Week 2010: a mixed bag

Last week was Sunshine Week, and to mark the occasion, the National Security Archive released a report titled "Sunshine and Shadows: The Clear Obama Message for Freedom of Information Meets Mixed Results." The report, based on an audit the Archive conducted of the federal government, found that only four of 28 responding agencies show FOIA releases up and denials down, compared to 2008.

Probably the most surprising part of the audit related to FOIA requests the Archive filed in September 2009, requesting information about the agencies' responses to the FOIA memoranda Pres. Obama and Atty. Gen. Holder issued in the spring of 2009:

Some agencies (13 out of 90) implemented concrete changes in practice as a result of the memos; some (14 out of 90) have made changes in staff training; and still others (11 out of 90) have merely circulated and discussed the memos. The remaining agencies (52) either told the Archive that they have no records that demonstrate how they implemented the Obama and Holder Memos or did not respond at all to the FOIA request.

While I didn't expect an overnight sea change in FOIA policy with Obama's election, it is hard to believe that such a small percentage of the agencies could provide any evidence that they took steps to comply with the memos, or even received them. If next year's audit does not find substantial improvement, it will be a serious rebuke of Obama's transparency platform.

In other (more promising) Sunshine Week news, Rep. Steve Israel (D-NY) is sponsoring a bill called the Public Online Information Act (POIA), which would set the bar for "public" information at "online in user-friendly formats." The Sunshine Foundation's website has more information about the bill, including a one-minute-long video explaining how it would improve transparency. Excerpt from the Sunshine Foundation's summary:

In the age of the Internet, government is transparent only when public information is available online. The Sunlight Foundation supports the Public Online Information Act (POIA), legislation that embraces a new formula for transparency: public equals online. No longer will antiquated government disclosure practices bury public information in out-of-the-way offices and in outmoded formats.

POIA requires Executive Branch agencies to publish all publicly available information on the Internet in a timely fashion and in user-friendly formats. It also creates an advisory committee to help develop government-wide Internet publication policies. Freeing government information from its paper silos provides the private sector with raw material to develop new products and services and gives the public what they need to participate in government as active and informed citizens. Establishing an advisory committee that brings all three branches of government and the private sector together to develop government-wide information best practices will improve how the government serves the American people.

Pillar on the relevance of "safe havens"

Paul Pillar's op-ed in the Washington Post last week was one of the more interesting pieces I've read about Obama's Afghanistan dilemma. Pillar questions one of the major underlying rationales for maintaining a military presence in the country: if the US leaves, it will return to being a terrorist "safe haven," which will inevitably lead to more 9/11-style attacks.

Pillar isn't attacking the argument that Afghanistan could return to being a safe haven if the US leaves - instead, he's questioning how important physical safe havens are to terrorism, considering that, as he puts it: "The preparations most important to the Sept. 11, 2001, attacks took place not in training camps in Afghanistan but, rather, in apartments in Germany, hotel rooms in Spain and flight schools in the United States." Don't Ask Don't Tell Madness

I've always thought Don't Ask Don't Tell was silly, but hearing the personal stories on Maddow, and from a friend whose dream is to be a JAG officer but knows she can't, has moved me into the category of being really pissed off about it. Victor Fehrenbach's story is one of the craziest, especially given the amount of expensive training a pilot receives. We're in TWO WARS right now, and this guy's getting fired?!

I had no idea "Don't Ask, Don't Tell" included mandatory investigations once anyone has accused a servicemember of being gay, and almost no one I've talked to about this case knew it was that harsh, either. I guess it's an example of how a policy's name can play a huge role in shaping public opinion about it. I'm confident that if the public understood how draconian DADT really is, legislation ending the practice would have 70-80% of the country's support. We can't afford to have a law this stupid any longer.

"For about a day, I have been quite worried about the 'Anonymous Student in Tehran' who was sending important dispatches to us of what he was seeing convulsively unfold in Iran. He had been quiet all day.

But we've just had a set of exchanges, and he's OK. I just learned that he will have an op-ed in tomorrow's New York Times under the pseudonym 'Shane M.'

It's exciting to see bloggers/twitterers living under repressive regimes demonstrating the ability of blogging/social media to make the world a more democratic place. And it's also good to see the Times embracing one of these voices, instead of keeping them separate from the "official" news.

The "long war" against FOIA via congressional exemptions

Not long after announcing that his administration would release more torture photos sought in a Freedom of Information Act lawsuit filed by ACLU, President Obama suddenly reversed his decision last month, and it appears that the flip-flop can be attributed to the Iraqi Prime Minister's warning that "Baghdad will burn" if they are released.

Senators Lindsey Graham and Joe Lieberman have been trying to pass an amendment which would exempt the controversial remaining photos of detainees from release under the Freedom of Information Act, with Graham saying that "This is the first shot in a long war . . . There are other lawsuits pending out there that want to compromise our national security in the name of freedom of information and transparency." (I hope my FOIA suit against the State Department, which is on hold until late July, doesn't fit into this category! I'm pretty sure it isn't one of the ones he is referring to.)

I understand Graham's argument that the pictures may provoke additional anger in Afghanistan and/or Iraq - after all, torture is inhumane, which is why it is banned under the Geneva Conventions, and why a majority of Americans were outraged when the first Abu Ghraib pictures surfaced several years ago. That said, it seems like most Iraqis would know about Abu Ghraib by now, and given what the country has gone through since 2003, it seems like a bit of a stretch to claim that the release of more photographs of detainee abuse would have such a dramatic impact, unless the photographs are particularly extreme or vile (and it should be noted that the Daily Telegraph report that the photos in question include images of rape has been debunked).

And if Congress starts exempting specific documents from the Freedom of Information Act - even in cases like this one, where two federal courts have ruled that the documents do not meet any of FOIA's statutory exemptions - it will set a dangerous precedent which would seriously undermine government transparency. Moreover, when Graham says that this is the "first shot in a long war" against FOIA and transparency in the national security context, it is clear that he envisions these congressional exemptions to FOIA being used on a regular basis, rather than being reserved for once-in-a-decade type situations. In other words, Lindsey Graham's own statements provide a strong "slippery slope" argument against his proposal.

The other major problem with Graham and Lieberman's proposal (and with the Obama administration's opposition to the release of the pictures) is the basic hypocrisy of demonizing the release of photographs depicting torture, yet simultaneously refusing to investigate the people behind the acts of torture themselves. If the mere release of more photographs depicting torture would be a "death sentence" to Americans serving overseas, as Graham claims, doesn't it follow that ordering American troops to torture detainees, and ordering them to photograph that torture for blackmail purposes (see this post) have put our troops at considerable risk? And if the neocons' decision to order our troops to torture detainees has put those troops at risk, doesn't it follow that we should have an investigation of some sort?

NC bans smoking in restaurants and bars

The NC legislature passed a bill yesterday which will ban smoking in restaurants and bars. It's a huge step forward, and it's pretty remarkable when you take a step back and think about it, given tobacco's role in the history of the state.

Iraq and the state of the newspaper industry

Recently, veteran Washington Post reporter Walter Pincus penned an essay for the Columbia Journalism Review on what led to the current state of the newspaper industry. Instead of just blaming the usual suspects - the loss of classified advertising to the internet, and the increasingly competitive media landscape - Pincus focuses on the "move away from expertise" in reporting and "the growth of public relations in government."

Most newspapers and the broadcast media have cut the number of reporters on beats. Meanwhile, young reporters are increasingly shifted from beat to beat, never having enough time to master complex subjects such as health care, public education, or environmental policies. As a result, more of their stories are based not on reportorial expertise, but on pronouncements by government sources or their critics.

Reporters are shifted around in part because of decreasing resources, and in part because within the profession, reporters are encouraged to become editors, editors to become publishers, and publishers of small papers pushed to manage bigger ones. This results in less expertise at the most important level—where reporters gather information.

Meanwhile, we have turned into a public-relations society. Much of the news Americans get each day was created to serve just that purpose—to be the news of the day. Many of our headlines come from events created by public relations—press conferences, speeches, press releases, canned reports, and, worst of all, snappy comments by “spokesmen” or “experts.” To serve as a counterpoint, we need reporters with expertise.

Consider the worst of recent examples. I believe the Bush administration sold the March 2003 invasion of Iraq to the American people beginning with a public-relations campaign that started in August 2002. Vice President Dick Cheney kicked it off with a series of speeches on the growing threat from Saddam Hussein, and it continued almost daily, with key members of the administration giving speeches, statements, or press conferences. The result was that the threat from Saddam Hussein—his alleged nuclear weapons, the idea that he would give chemical or biological weapons to terrorists—dominated news coverage right up to the time the first missiles hit Baghdad on March 19, 2003. I'm glad to hear a top reporter put some of the blame for the current state of the industry at the hands of publications themselves. Personally, the media's failure to provide quality coverage during the lead-up to the Iraq War was what inspired me to start this blog (not that I have any delusions that it could fill the shoes of a major newspaper). When I hear about a newspaper closing its doors, the first thing I do is worry about how it will impact the news landscape, and feel sorry for the reporters who have lost their jobs. But then a part of me thinks back to 2003 and says: "Wait, I'm supposed to be sad that another company that was involved with that is going under?"

I know it's a little irrational to hold the entire industry responsible for the selling of a war. But the American newspapers' Iraq debacle came at the exact wrong time: the moment that internet news sites and blogs were first gaining widespread legitimacy. The mainstream media's woeful coverage of the lead-up to Iraq probably did more to level the playing field for alternative media outlets than any other single factor.

The very complicated issue of political independence at the DOJ

After the release of more DOJ torture memos last week, President Obama said that he would not prosecute the CIA interrogators who carried out the Bush administration's orders. Keith Olbermann and other commentators interpreted Obama's statement broadly, taking it to mean that there would be no prosecutions related to the torture issue whatsoever. My initial take on it was that this interpretation of the President's comments was a little too broad, although I understood the point Olbermann et. al. were making - that prosecutions of the federal employees who actually committed the torture would probably be the most straightforward way to bring their superiors (who created/approved the interrogation policies) into court.

Today, Obama provided a clarification on this issue:

"For those who carried out some of these operations within the four corners of legal opinions or guidance that had been provided from the White House, I do not think it's appropriate for them to be prosecuted.

With respect to those who formulated those legal decisions, I would say that that is going to be more of a decision for the Attorney General within the parameters of various laws, and I don't want to prejudge that. I think that there are a host of very complicated issues involved there." [Marc Ambinder]

So he wasn't saying that prosecutions are off the table. That said, there are problems with the AG being "the decider" (to use a Bushism). One of the main reasons Obama has been hesitant about investigations or prosecutions of Bush officials is that he wants to avoid the appearance of partisanship. And while Attorney General Holder is serious about restoring the DOJ's political independence, he remains one of Obama's most visible appointments, and one of the most visible examples of the "Change" Obama promised. If Holder calls for prosecutions of members of the administration whose record Obama won by running against, it could create the (wholly unfair) perception that he is Obama's Alberto Gonzales.

What's especially frustrating about the situation is that the Bush DOJ's lack of political independence probably makes it even harder for the Obama DOJ to undertake controversial prosecutions without appearing unduly politicized. After eight years of the DOJ being run by yes men, some Americans might just assume that the attorney general is supposed to base prosecutorial decisions on the President's political agenda - and would not draw any distinction between Holder and Obama.

That's at least one of the "very complicated issues" Obama faces when it comes to torture prosecutions. Another issue may be the fear that prosecuting members of a previous administration over their policies could set a dangerous precedent, inviting payback in the form of prosecutions by a subsequent Republican administration. It isn't hard to imagine that line of argument: "they weren't satisfied with beating us in the 2008 election, they had to rub it in by prosecuting us over the policies they didn't agree with. If they can, why can't we?" I'm not suggesting that the Obama administration will do anything as controversial or illegal as the Bush administration's torture program, but I have a feeling that wouldn't stop the GOP from trying (see Clinton impeachment).

Increasingly, some kind of congressional investigation or 9/11 Commission-style blue-ribbon panel investigation looks like a better option for the Obama administration, and the President sounded more open to the idea today than he has before, saying that any congressional investigation would need to be carried out in a "bipartisan fashion." [Bloomberg] The only problem with that is that the GOP leadership hasn't shown much interest in throwing the Bush administration under the bus, aside from saying that Bush strayed from the party's fiscal conservatism.

Which surprises me, to be honest. As it stands now, everyone my age (31) and younger will permanently associate the GOP with Bush, Cheney, Rumsfeld, et. al. And the GOP's core strategy - repeating the same old platitudes about Reagan - is not going to make the association between their party and the Bush administration go away. Reagan was out of office by the time I was twelve, and moreover, most of his big ideas have been proven wrong in the twenty years since then.

If the Republican leadership has any interest in competing nationally again, the smartest thing they could do right now would be to take an active role in a bipartisan investigation of pre-Iraq intelligence and torture - making it clear that those were the Bush administration's policies, not theirs, and that we are wrong for lumping them in with people who would lie about something as serious as the rationales for starting a war our friends and classmates would fight, or would put the United States on the "countries that torture" list alongside serial human rights violators like China and Syria. Until the GOP throws the Bush administration under the bus, Bush will still be in the driver's seat, with Cheney riding shotgun.

UNC Chancellor issues statement on Tancredo protest

On Monday night, former Congressman and anti-immigration activist Tom Tancredo spoke at an event at UNC-Chapel Hill, sponsored by a student group called Youth for Western Civilization. Tancredo was brought in to give a speech against illegal immigrants receiving in-state tuition at state schools.

Protesters interrupted his speech almost as soon as he started talking, and things got completely out of hand: some students blocked Tancredo from sight with a 12-foot banner, and someone even broke a window. Police used pepper spray in response, and threatened to use Tasers.

As a UNC graduate who disagrees with most of Tancredo's political views, including his perspective on immigration policy, I find it very troubling that he was not even allowed to speak. Don't get me wrong - I am not criticizing anyone for protesting, marching, or even holding up contrarian signs during a speech (as long as the signs don't block anyone's view of the speaker). But there's a big difference between protesting and physically blocking someone from view, shouting him down while he's trying to speak, and pounding on a window until it shatters.

If I had to pick the one overriding reason I consider myself a moderate or a moderate liberal, it would be that I can't stand the tendency among the far left to demonize everyone who disagrees with you. In that mindset, there's an exemption to the free speech rights the rest of us enjoy: all you have to do is label someone else's point-of-view as "hate" and your disruption of free speech is not only exempted, it's sanctified. I wish a widely-respected liberal constitutional rights expert like Glenn Greenwald would weigh in on this one.

Earlier this evening, UNC Chancellor Holden Thorp issued a statement on the Tancredo incident to members of the General Alumni Association, and I think he said exactly what needs to be said:

Message from the Chancellor: Free Speech at Carolina (April 15, 2009)

Dear Students, Faculty and Staff:

I want to express how disappointed I am in what happened last night when former Congressman Tom Tancredo wasn't able to speak when a protest got out of hand, and our Department of Public Safety had to take action. Congressman Tancredo felt threatened and left without making his remarks.

Mr. Tancredo was scheduled to speak about immigration. We expect protests about controversial subjects at Carolina. That's part of our culture. But we also pride ourselves on being a place where all points of view can be expressed and heard. There's a way to protest that respects free speech and allows people with opposing views to be heard. Here that's often meant that groups protesting a speaker have displayed signs or banners, silently expressing their opinions while the speaker had his or her say. That didn't happen last night.

On behalf of our University community, I called Mr. Tancredo today to apologize for how he was treated. In addition, our Department of Public Safety is investigating this incident. They will pursue criminal charges if any are warranted. Our Division of Student Affairs is also investigating student involvement in the protest. If that investigation determines sufficient evidence, participating students could face Honor Court proceedings.

Carolina's tradition of free speech is a fundamental part of what has made this place special for more than 200 years. Let's recommit ourselves to that ideal.

FOIA lawsuit vs. the State Department

On March 26, 2009, I filed a Freedom of Information Act lawsuit against the State Department in federal court, to try to force the agency to disclose some pre-Iraq War planning documents. Specifically, the main document I'm after is the "chinese menu" of possible rationales for invading Iraq which was created by the Pentagon's Office of Special Plans, and was presented by Scooter Libby to Colin Powell and other administration officials on January 25, 2003. Page 297 of Bob Woodward's Plan of Attack says that "Libby provided a 60-page version of the case - some 50 percent more than the CIA paper - which he viewed as a kind of Chinese menu fom which Powell could select."

I have been trying to get this document released since 2006, mostly through FOIA requests submitted to the Defense Department. In February, I renewed my efforts with new requests to the Defense and State Departments (while Pentagon employees created it, Powell and other former State Department officials were the recipients of the document, so it should be in their files). The DOD responded within the 20-day statutory period, but the State Department failed to respond, which triggered a cause of action in district court under FOIA (5 U.S.C. 552(a)(4)(B), to be specific).

In addition to asking the court to compel the State Department to release the document and other related documents, the lawsuit also asks the court to grant me FOIA's "representative of the news media" fee waiver, which means that processing fees related to this request would be waived. Under FOIA, media outlets do not have to pay these fees, and the Open Government Act of 2007 amended FOIA to clarify that the "representative of the news media" fee waiver is intended to include citizen journalists and/or bloggers who can show that they gather information, create a distinct work, and distribute that work to an audience (Congress didn't use the "b"-word in the law itself, but Senator Leahy, who introduced it, specially talked about bloggers in his floor statement just prior to the passage of the bill). Based on my research, I have not been able to find any instances of a blogger getting the news media waiver, and one goal of mine is to provide an example of how other bloggers can successfully request the waiver.

Anyway, now the ball is in the State Department's court to provide an answer to my complaint, and that should be forthcoming in the next week or two. I will be providing updates once things get moving.

Sunshine Week and bloggers' role in FOIA research

This week is Sunshine Week, an annual event created to draw attention to government transparency issues. In today's Washington Post, ombudsman Andrew Alexander criticizes his paper for not participating in Sunshine Week, and also for failing to take a more prominent role in the transparency debate:

"Post reporters routinely file Freedom of Information Act requests to dislodge public records. Editorials warn about the dangers of government secrecy. And the newspaper is willing to sue government agencies to force disclosure of documents. It cares about the public's right to know.

So you would think that with its stature, here in the nation's capital, The Post would be the leader in fighting for transparency. It isn't.

Other newspapers are more assertive on their news pages in championing the cause. Pioneering Web sites are much better at giving readers access to government data. And some open-government advocates feel The Post hasn't done enough to curb Washington's corrosive culture of anonymity."

I agree with Alexander that our top newspapers should do more in the transparency/FOIA department. But even if they don't, transparency groups and blogs can help fill the void - and they already have been. Whereas much of the debate over the rise of blogs centers around whether they can or will replace newspapers, I have always envisioned blogs playing a complimentary role: allowing more voices into the debate, providing citizens with a check on the mainstream media, and perhaps most importantly, filling gaps in niche areas the media fails to cover (for political reasons, or just for economic and profit-motive reasons).

FOIA is a great example of an area where blogs can excel in this gap-filling role. Getting controversial documents released under FOIA can be a very involved, complicated process, often requiring extensive research on very a narrow facet of some policy issue. In contrast, good newspaper articles usually provide a broader picture of a given policy issue, because the goal is to give readers a better general understanding of the issue, and not the specific details of a single memo or document.

Since I got the Rumsfeld memo in 2006, I've been working on getting a major pre-Iraq war planning document released under FOIA from the Defense and State departments - the presentation of arguments for invading Iraq that the neocons gave to Colin Powell prior to his UN presentation, telling him to choose from the various rationales "like a Chinese menu" - and I have reason to believe it may be released in the near future. I've also been applying for FOIA's "representative of the news media" fee waiver, which lets media outlets like the Post get FOIA documents without paying the processing fees bloggers currently have to pay. In 2007, Congress amended FOIA to make it easier for bloggers and citizen journalists to apply for the waiver, but to my knowledge, no one has gotten it yet.

In the last few years, a lot of bloggers and other citizen journalists have obtained important documents under FOIA (most recently, TPM got an index of reports prepared by the DoD's think tank). In addition to the obvious goal of saving money in FOIA processing fees, my motivation for fighting for the fee waiver is to bring attention to the work bloggers and other citizen journalists have done in this area. DOJ releases Bush-era memos on war on terror

It's hard to even know where to start with the previously-secret war on terror memos released by the DOJ yesterday. The memos were released in response to a massive ongoing Freedom of Information Act lawsuit the ACLU brought seeking the release of information about the capture and treament of terror suspects. From my perspective, the most important thing they show us is that the Obama administration appears to be very serious about living up to his campaign promise to improve government transparency - and they may signal a new era in FOIA.

I'm busy this week, and haven't had a chance to read through them yet, so I will defer to some well-informed writers who have. The Post's Dan Froomkin, Salon's Glenn Greenwald, and Yale law professor Jack Balkin have good overviews of the memos (Balkin's has a good overview of the recent memos from the Bush DOJ distancing itself from the earlier ones). From reading the various commentary, the most absurd argument in the memos might be John Yoo's claim that the Foreign Intelligence Surveillance Act (FISA) doesn't apply to national security surveillance, because it did not include a "clear statement" showing that was its intent. As GW law professor Orin Kerr explains, not only was the undeniable purpose of the law to regulate national security surveillance, but federal law actually says that it is the exclusive way such spying can be conducted.

Want to hear something depressing? Yoo is currently employed as a law school professor: he's a visiting professor at Chapman University School of Law in California, and that state's taxpayers should know that he's still on the Berkeley payroll.

I thought President Obama's speech to the Marines at Camp Lejeune today was almost as impressive as the address to Congress earlier this week. After all, his opposition to the Iraq war was what gave him his initial opening in the Democratic primary; today, as President, he had to explain how he would end the war without belittling his audience's service and sacrifice in it. He pulled it off with the perfect tone, drawing a distinction between the controversial decision to invade and the military's accomplishment of most of the various tasks it was assigned in Iraq.

The most impressive part of the Obama's speech, and the only part that really surprised me, was the thematic link to one of the central themes of his address earlier in the week, American's shared responsibility for the economic crisis, which he contrasted with the sacrifices made by the servicemen and women:

You make up a fraction of the American population, but in an age when so many people and institutions have acted irresponsibly, so many of you did the opposite. You volunteered to bear the heaviest burden.

To put it simply, he was a very credible Commander-in-Chief.

Truth commission finds an unlikely ally in Jones

The media and punditry have paid a lot of attention to where the Republican party goes from here, in the wake of that party's losses in 2006 and 2008. But one of the most interesting stories involving a Republican elected official has largely been ignored. Two weeks ago, Rep. Walter Jones (R-NC) signed on as a co-sponsor of John Conyer's bill to create a National Commission on Presidential War Powers and Civil Liberties (the 3rd district, which Jones represents, is shaded green in the map shown above).

What makes Jones' support for the bill especially surprising is that he has a very conservative voting record, and was actually the original sponsor of the bill that renamed french fries as "Freedom Fries" in the House cafeteria just before the 2003 invasion of Iraq. But as the country learned more about pre-war intelligence, Jones became a harsh critic of the war, and in 2005, he joined Dennis Kucinich (D-OH) and Ron Paul (R-TX) to co-sponsor a bill calling for a withdrawal from Iraq by 2006. When a reporter asked him to explain why he changed his mind about Iraq, he said: "If we were given misinformation intentionally by people in this administration, to commit the authority to send boys, and in some instances girls, to go into Iraq, that is wrong."

To understand Jones' perspective, it is important to understand that his district is one of the most military-oriented congressional districts in the country, as it is home to several Marine bases: Camp Lejeune and the New River Air Station in the Jacksonville area, and Cherry Point Air Station in Havelock. Of the 17,000 troops President Obama recently announced he would be sending into Afghanistan, 8,000 of them are Marines shipping out of Camp Lejeune. So there only a few other districts where the human costs of the two wars have been felt as much as they have in North Carolina's 3rd. I spend a lot of time at the area's beaches, and on a recent trip, the folks at the seafood market asked me if I had been in Iraq. I was confused at first, and then realized that was a good assumption since I was wearing cargo shorts and a buzz cut, and I said, "no, no, I'm just a wannabe."

It is going to be interesting to see what comes out of the current push for a commission or other investigation into the Bush administration's war on terror policies. The NY Times has a great article about the different forms this commission could take. While I definitely support the idea in principle, the Democrat and Obama supporter in me fears that it could backfire if there isn't enough support from key Republicans. If the Republican leadership successfully blocks major parts of Obama's policy agenda between now and the 2010 midterm elections (think health care and clean energy/climate change policies), and the truth commission ends up dominating the headlines, it would give the GOP an opening to claim that Obama and the Congressional Democrats are stuck in the past, and don't have bipartisan solutions to the problems we face. I think this is what Obama fears, and that's why he's saying he is more interested in "looking forward" than in "looking backwards" at Bush's war on terror.

That said, there's another scenario where a truth commission could help everyone. I don't think the GOP will be able to take the presidency again until its leaders admit that many of the problems we face require some sort of federal regulation/intervention (like health care and climate change), and separate themselves from Bush and Cheney, who will continue to represent the party in the minds of a whole generation of voters for the foreseeable future. So from that perspective, supporting a truth commission might be the smartest thing McCain, Graham, Steele and other prominent Republicans could do right now. But I won't be holding my breath.

Obama orders Afghanistan surge

President Obama's sending 17,000 more troops to Afghanistan, including 8,000 Marines from Camp Lejeune in Jacksonville, NC. When you consider that a new UN report found that civilian casualties jumped by 40% in 2008 over 2007, it really seems like Afghanistan is right on the verge of slipping out of control, and that a surge could help stabilize things. And with the strong Al Qaeda/Taliban presence in the tribal areas around Afghanistan's mountainous border with Pakistan (and increasingly, in areas of Pakistan beyond the border), Obama's campaign line about Afghanistan being the center of the war on terror seems truer than ever.

A friend of mine from DC, who is a good friend of my roommate's, is in the Navy Reserve and was recently recalled to active duty in Kabul. He's been blogging about his experiences over there, and it's definitely an interesting read. Notes from Inauguration Day

I volunteered for the Presidential Inaugural Committee on Inauguration Day, helping supervise the distribution of approximately 300,000 6"x9" American flags. I got down to the Mall just after 3 AM, and I was ready for the cold, with Ben-Gay heat patches on both of my legs, just above the knee, and a bag full of hand-warmers. Getting into the Mall itself was a bit of a daunting task. We tried to enter at 7th and E Streets NW, close to where our trailer and shipping containers of flags were, and the cops told us we had to walk all the way around the White House, and enter the Mall near the Washington Monument.

On the way over, we passed hundreds of other people trying to figure out how to get into the Mall, constantly stopping and comparing notes to see if anyone had tried 18th Street, past the White House. During one of these conversations, one guy came up and asked if anyone had a phone he could use. Finally, I said he could use mine, but I stood about six inches from him while he called, so I could grab him in case he tried to run off with it. When he told whoever he was calling that he'd probably just sleep on a heating grate for a while, I tensed up, and kept repeating to myself "Don't you dare take advantage of my kindness." But when he was done, he just handed the phone back and thanked me. We moved on and stopped in for some coffee at a Starbucks, which was already packed at 3:30 AM - it was one of the only outposts of warmth, and it was 18 degrees outside.

When we finally made it to 18th and headed south, we came upon one of the most random things I have ever seen. Halfway down one of the empty, sterile streets in Washington's business district, past one of the empty Metro buses the city was using to block off streets (which gave downtown a disaster-flick vibe), twenty-five or thirty people were out in the middle of the street, dancing to the title track from Footloose! We couldn't tell if the music was coming from a bar's PA system, or someone's car stereo, or what, and it was too cold to waste any time trying to find out. We had to just keep moving, and file that away in the part of the brain that stores absurd spectacles we'll almost forget about.

We made it to the trailer around 4:15 or 4:30, and by 5:00, twenty-five or thirty local Girl and Boy Scout troops met us on the Mall to help with the flags. We got moving quickly, because by 5:30, there was already a constant stream of people onto the Mall. By the time the ceremony started, we had the non-ticketed of the Mall covered pretty well. In an era of cynicism and frustration with the federal government, it felt great to see people so excited when we offered them American flags. With thousands of vendors hawking anything and everything Obama-related on every corner of downtown DC (including rip-offs like 5"x8" photos printed on the most average paper stock you can imagine for $5), we got people's attention when we told them that the flags were free. As I joked, it was the best deal in town.

The Inaugural Committee had the sense to play something on the Jumbotrons during the morning, so all the people who got there early would have something to do while they waited, and they aired Sunday's concert at the Lincoln Memorial, which had featured a speech by Obama, and music/appearances from Springsteen with Pete Seeger ("This Land Is Your Land"), Stevie Wonder with Usher, Denzel Washington, U2 performing a song that had been an Obama campaign appearance staple, Beyonce, etc., etc., etc.

Yet, the most "red-state" of the performers seemed to get the biggest applause - Garth Brooks, who played a countrified medley which included "Bye, bye, Ms. American Pie," and "(You Make Me Wanna) Shout." On Tuesday morning, my section (which was probably 60% black, and overwhelmingly Democrats from "blue-states," not exactly Brooks' target demographic) went completely nuts when his taped version of "Shout" came on, with everyone singing along, jumping, and waving their flags. As someone who spent much of his teens and twenties trying to see as many bands as possible, I don't think I've ever witnessed a song elicit that much excitement. All of our energy had been bottled up in the 20-degree weather and the darkness, and Garth Brooks finally uncorked it.

When the ceremony finally started up, and the more famous Democratic Senators came out to sit down, followed by the Obama girls, my section got even more excited, and it turned into an ocean of flags. Every time Senator Feinstein said "The Next President of the United States, Barack Obama," it was greeted with roars by all of us. When the screen showed Bush, most of us looked around awkwardly, not knowing what to say, except for the folks who started singing "Nah nah nah nah, hey hey hey, Good-bye." I waved my flag for him and clapped, and it felt good giving the guy a break for once.

After all this exultation, Obama's stoically realist address was a little anti-climatic, but that definitely seemed intentional. If he had come out beaming, basking in the excitement of the moment, with the economy falling further out from under us each day, he would have appeared out-of-touch. One of Obama's greatest strengths is knowing what he doesn't need to say. He didn't campaign on a platform of "vote for me, because electing a black person would be historic" - he knew that aspect of his candidacy would generate enough excitement on its own. While his address made a reference or two to the civil rights advancements his election represented, he mostly let that obvious triumph speak for itself through the image of a black man taking the oath of office.

Similarly, Obama avoided resting on the laurels of the strong "Bush is finally gone" sentiment, which had been anticipated for years by the popular "1/20/2009" bumper sticker. Obama tapped into that sentiment, by calling for a return to the values and hard work that made America great, but also promised new approaches to pressing issues in areas like the economy, energy, and foreign policy.

For years, my goal for the 2008 election was mostly just to get a president who cared about the way our government is supposed to work - someone who would bring us back to normal (for example, back to being one of the modern, civilized counties which doesn't torture, and off the short list of rogue countries which do), and would make sincere efforts to make government more effective (in contrast to the Bush administration's overt weakening of regulators). Obama has fused strains of that traditionalist mindset with tech-savvy, forward-looking policy approaches, putting more of an emphasis on doing what works than following party orthodoxy.

In fact, pragmatism was at the heart of some of the most important lines of Obama's address: "What the cynics fail to understand is that the ground has shifted beneath them, that the stale political arguments that have consumed us for so long, no longer apply. The question we ask today is not whether our government is too big or too small, but whether it works, whether it helps families find jobs at a decent wage, care they can afford, a retirement that is dignified."

During the primary and election, some on the left ridiculed Obama's oft-repeated promise to take a post-partisan, or post-ideological approach, dismissing that kind of talk as a political stunt. Incredibly, the same crowd is up in arms whenever Obama takes a centrist policy approach, gives a Republican credit for having a good idea, or appoints someone they do not consider ideologically pure (like Cass Sunstein, the legal/policy genius who will head of the Office of Information and Regulatory Affairs, and whose book "Nudge" embodies a lot of my own political values).

In contrast, Obama's post-ideological streak is one of the things that excites me most about his presidency. When I started outragedmoderates.org in 2004, I cited the following textbook definition of "moderate": "someone who weighs each issue on its own, rather than following a strict party line or ideology." President Obama fits squarely into my definition of the term, and if his administration fulfills its promise, one of the lasting examples of "Change" may be a less binary, more nuanced American political conversation.

Obama Should Appoint a Government Transparency Officer

Last week, I attended a panel discussion hosted by the New America Foundation called "Wiki White House." The event was hosted by Google at the company's DC headquarters near the Verizon Center, and the panel members included Ellen Miller of the Sunlight Foundation and Craig Newmark of Craigslist fame.

The New America Foundation has a video of the whole discussion up; I'm going to use this post to discuss some of Miller's comments, and to provide a layman's answer to the first question asked of the panelists: how would you like to see the Obama administration use technology to improve governance?

When asked what would be on her "wishlist," Miller emphasized the need for a Chief Technology Officer, who would have the high-level access necessary to be a forceful advocate for new uses of technology. She added that this needed to happen in the first 100 days.

This struck me as something that will be a key indicator of how serious the administration is about changing government through technology. Given the size and scope of the federal bureaucracy, organizational structure is everything: if a policy area like technology does not get a specific place in that pecking order now, it will not get the attention it deserves during the rest of the term, regardless of good intentions at the White House level.

This blogger's wishlist would include not only the naming of a Chief Technology Officer, but also the creation of another post: Government Transparency Officer. The Government Transparency Officer would be a politically independent officer who would serve as an ombudsman of sorts for the American people. The position would be tasked with the following duties:

1) Operate a user-friendly website which would serve a portal for various forms of government information.

The GTO's site would provide links to major government reports, proposed laws and policies, and new Freedom of Information Act releases. Much of this information is already out there somewhere - but most citizens do not know where to look.

The "low-hanging fruit" part of this task would be creating a centralized portal, providing links directing interested citizens to the appropriate existing sources of information, like USASpending.gov (the Google-the-Government site Obama co-sponsored), or the Library of Congress' Thomas system, or the Government Printing Office. As it is now, citizens have to a) know about a site like USASpending.gov, and then b) find it online (and I would bet that even most fans of the "Google-the-Government" legislation do not know the domain name). With a centralized, heavily-publicized GTO site, every citizen would have a starting point from which to learn more about their government. Moreover, the GTO site would feature a user-friendly design geared towards helping citizens find information by topic/issue, instead of requiring that they know specific bill names/numbers or sponsors, as is the case with many government sites.

In addition to directing citizens to information which is already available on government sites, the GTO site would provide links to proposed laws and policies by issue. Take climate change, which will be one of the key issues before Congress this year. There are currently several different major proposals in Congress for fighting climate change, including the Boxer-Saunders bill, the McCain-Lieberman bill, and the Bingaman bill. But just trying to get a good idea of the key differences between the top proposals can be difficult, especially for anyone who isn't a seasoned researcher. For major issues before Congress, the GTO site would compile user-friendly charts providing the key differences between bills, and would provide links for further information the proposals.

Finally, the site would include a central registry of Freedom Of Information Act releases, ideally a searchable database which citizens could sort by agency, topic, or date. Some agencies, like the FBI, already have an electronic reading room which allows citizens to view its most-requested documents. What if there was a central electronic reading room where citizens could view recent FOIA releases from the entire federal government?

After the Wiki White House event, I mentioned this idea to Ellen Miller, and she replied that there had been a push from open government groups to get the federal government to release an ongoing list of FOIA releases by agency. If the government did not agree to release a registry, the GTO could just create its own - asking successful FOIA requesters to send in copies of the documents they receive, along with a notarized statement swearing to the documents' legitimacy, and the GTO would then contact the respective agency to confirm that the documents were indeed released.

2) Serve as an ombudsman who would advocate on behalf of citizens' access to information.

In addition to providing citizens with information, the Government Transparency Officer would serve as a representative of the American people on transparency issues. He or she would publicly weigh in on proposals which impact transparency, by testifying before Congress and/or making media appearances advocating new transparency laws along the lines of the Google-the-Government bill. And if the administration or Congress violated transparency laws, or conducted operations in an unduly secretive manner, the GTO would push back, privately and publicly. Citizens could contact the GTO with transparency questions, and potentially bring to his/her attention issues which warrant action by the officer.

In summary, appointing a Government Transparency Officer would send a strong signal that the Obama administration is serious about changing Washington. The GTO's information portal would bring Washington up to speed with the rest of the internet, giving citizens more access to government information, and just as importantly, easier access to government information, than ever before. As James Madison once wrote (emphasis added): "A popular Government without popular information or the means of acquiring it, is but a Prologue to a Farce or a Tragedy or perhaps both."

The GTO's ombudsman role would help keep the rest of the federal government in compliance with transparency laws, and it would mean that there was always someone advocating for greater transparency when the administration and/or Congress make new policy. Moreover, giving citizens a transparency ombudsman to file complaints with would be a step towards restoring Americans' faith in government.

Finally, creating a visible, high-ranking Government Transparency Officer post would have a normative effect, reminding American citizens that our democratic system is supposed to be operated in an open, transparent manner. As I noted in a recent summary of the President-Elect's legislative record, improving transparency was arguably the unifying theme of his career in the Illinois State Senate. By creating a high-level post tasked with promoting and defending government transparency, President Obama would build on that record and make a lasting improvement to the operations of the federal government.

IT'S OFFICIAL: NC GOES BLUE FOR OBAMA!

I can finally truly celebrate Obama's victory. I couldn't really celebrate until now. I know that sounds insane, and that's fine if it does. But I wasn't even truly happy during Obama's speech Tuesday night, because we weren't part of it. Now we are, and the US electoral map has officially changed, probably forever. By 2030, NC is projected to be the #7 most populated state, which will bring its electoral votes from 15 up to 20/21/22. And the state's electorate will only be getting bluer and bluer.

Basically, the Republicans have a new Pennsylvania they will have to worry about in every election from here on out.

Working for Obama in the NC Mountains

I haven't been blogging lately because I was offered a Get Out The Vote position with the Obama campaign in the mountains of North Carolina. Most of my father's family is from McDowell County, so I spent a lot of time in the mountains during my childhood. I can't put into words how exciting it is to be working for the Obama campaign in my home state, especially in a part of the state where much of my family tree is rooted. Once I got the assignment, I made some "Scotch-Irish For Obama" buttons with the help of a couple of friends of mine, and it has been fun wearing mine around town (call me biased, but the plaid in the background is the Anderson tartan).

I can't talk about anything campaign-related, but I can say that the support for Obama in the mountains definitely includes a broader range of people than I had expected (it's not just Asheville, which is one of the most liberal cities in the Southeast). The man pictured above, who lives in Swain County, is probably one of the most compelling examples.

Anyway, I will resume blogging sometime after Election Day - in the meantime, don't forget to vote.

In the case of his videotaped interrogations law, Obama eventually was able to convince skeptical law enforcement officials and Republican legislators that transparency would improve the criminal justice system for everyone, because, in his words, "the videotaping of interrogations and confessions is both a tool for protecting the innocent as well as a tool for convicting the guilty." In his three-and-a-half years as a U.S. Senator, Barack Obama has built a record that supports his campaign’s emphasis on reform. During that time, the Illinois Democrat has also demonstrated a strong willingness to reach across the aisle, co-sponsoring legislation with Republican Senators like Dick Lugar (R-IN), Chuck Hagel (R-NE), Tom Coburn (R-OK), and even his current opponent, John McCain (R-AZ). In a hearing on the Coburn-Obama bill, McCain, who was also one of the bill's co-sponsors, said: "I want to again thank the bipartisanship that is associated with this bill, including Senator Carper and Senator Obama." THE ETHICS REFORM LAW

Barack Obama's emergence as a national leader on the issue of ethics reform has probably been the most impressive aspect of his career in the U.S. Senate, and it would have been impossible without his strong track record of reform in the Illinois State Senate. The Democratic Party successfully ran on a platform of changing Washington’s "culture of corruption" in the 2006 congressional elections, and party leaders made ethics reform their first order of business. Obama and Russ Feingold (D-WI) were tapped to lead the party's high-profile push for new ethics standards, and together they drafted a "gold standard bill" (http://tinyurl.com/3e4x86), which included bans on gifts, meals and travel funded by lobbyists, a new requirement that legislators to pay charter rates on corporate jets, and greater disclosure of donation "bundling" by lobbyists (http://tinyurl.com/5tzczf).

Feingold and Obama introduced their bill on January 8th, and several days later, Sen. Jim DeMint (R-SC) authored an amendment which would strengthen the legislation’s prohibitions on anonymous earmarks, requiring public disclosure of which legislator is responsible for adding an earmark to a piece of legislation (http://tinyurl.com/57nxka). Senate Majority Leader Harry Reid (D-NV) opposed the DeMint amendment and pressured the Democrats to vote to table the amendment - but the motion to table it failed, because nine Democrats, along with Joe Lieberman (I-CT), voted with the Republicans to keep the DeMint amendment. Among the Democrats who broke ranks with their party’s leadership were the two drafters of the ethics bill, Feingold and Obama, former Presidential candidate John Kerry (D-MA), and newly-elected Senators John Tester (D-MT) and Jim Webb (D-VA) (http://tinyurl.com/2zwlbp). Next, Feingold and Obama introduced an amendment to address the issue of Washington’s "revolving door" - legislators leaving the public sector to work as lobbyists. American University political science professor James Thurber predicted that the law would have a substantial impact: "It will change lawmakers' behavior and lobbyists' behavior as well, and it will bring more transparency to lobbying." THE LUGAR-OBAMA PROLIFERATION AND THREAT REDUCTION INITIATIVE

One of Senator Obama's first major achievements in the U.S. Senate was working with Sen. Dick Lugar (R-IN) as a co-sponsor of the Lugar-Obama proliferation and threat reduction initiative (http://tinyurl.com/5gdolf), which updates the programs established by the Nunn-Lugar Cooperative Threat Reduction Program. The Nunn-Lugar law, passed in 1992, focused on the interdiction of unsecured WMD's in the recently-dissolved Soviet Union, especially nuclear weapons; the Lugar-Obama law expands the scope of those programs to include conventional (non-WMD) weapons like shoulder-fired anti-aircraft missiles, and also bolsters the State Department's ability to interdict materials used to make WMD's.

According to Lugar's press release hailing the passage of the legislation, the bill had its roots in the senators' work together on the Nunn-Lugar programs: "Lugar and Obama traveled together to Russia, Ukraine and Azerbaijan in August 2005 to oversee a number of Nunn-Lugar projects. In Ukraine they saw a conventional weapons facility that is typical of the focus of the new legislation." (http://tinyurl.com/689mos). In a 2006 article, the Washington Monthly described Lugar as Obama's mentor in the Senate, calling the bipartisan pairing "the most dynamic duo in Washington today," and attributing their collaborative relationship to a shared realist approach to foreign policy (http://tinyurl.com/2su5f5).

THE OBAMA-HAGEL COMPREHENSIVE NUCLEAR THREAT REDUCTION PROVISION

In addition to the Lugar-Obama threat reduction law, the Illinois Democrat co-authored the Comprehensive Nuclear Threat Reduction provision with Sen. Chuck Hagel (R-NE), which was attached to the omnibus appropriations bill signed into law in December 2007. According to a press release issued by Rep. Adam Schiff (D-CA), who sponsored the bill in the House, the Obama-Hagel provision "requires the President to submit to Congress a comprehensive plan for ensuring that all nuclear weapons and weapons-usable material at vulnerable sites around the world are secure by 2012 from the threats that terrorists have shown they can pose." THE COBURN-OBAMA "GOOGLE THE GOVERNMENT" LAW

Obama was the lead co-sponsor of the Federal Funding Accountability and Transparency Act of 2006 (http://tinyurl.com/659tuf) - often called the "Google the Government" law, or the Coburn-Obama law - which created a searchable database that allows citizens to track federal spending (http://www.USAspending.gov). Sen. Tom Coburn (R-OK), the bill's sponsor, referred to it as the "Coburn-Obama Bill" in his press release hailing the bill's passage (http://tinyurl.com/movxq). Obama's role in the passage of the "Google the Government" law not only demonstrates his commitment to using technology as a tool for transparency and government reform, but also provides a particularly striking example of his willingness to work across the aisle, as Coburn is one of the most conservative members of Senate.

In an op-ed piece they co-authored after the bill was signed into law, Coburn and Obama highlighted the bi-partisan nature of the legislation: "In the Internet age, making this information available online should be automatic, which is why a vast array of interest groups, bloggers and commentators from both ends of the political spectrum joined forces to put public pressure on Congress when the bill was stalled. If nothing else, this activism and this bill are a testament to a hunger that exists in America today. It's a non-partisan hunger for a government that's honest and open — one that spends our hard-earned tax dollars wisely, efficiently and transparently." (http://tinyurl.com/6rmfqu).

Ironically, Senator McCain, who claimed in his convention speech that Obama has not "worked with members of both parties to fix problems that need to be fixed," was actually one of the Coburn-Obama bill's co-sponsors. In fact, during a July 18, 2006 hearing on the bill, McCain said "I want to again thank the bipartisanship that is associated with this bill, including Senator Carper and Senator Obama." Facebook Group: Fans of Barack Obama's Legislative Record

Over the weekend, I created a Facebook Group called "Fans of Barack Obama's Legislative Record." If you're a Facebook user, check it out (and note that you don't have to join the group to visit the site).

The goal of the group is to provide a convenient place for Facebook users to find and share information about Barack Obama's legislative record, in the wake of the attacks from the McCain-Palin campaign. Everyone's on Facebook 24-7 already - and the idea is that next time you're chatting with a friend about the election on Facebook's chat app, or having a long phone conversation with your grandmother who happens to live in a key swing state, you'll have a place to go for a quick talking point. The group page features a brief, but detailed, summary of Obama's legislative career, with links to more information about legislation he has sponsored or supported.

Obama's "Change" mantra would be nothing more than a campaign slogan without his strong record on ethics reform and government transparency - and we Obama supporters should not be surprised or offended that voters who are unfamiliar with his record may be skeptical. When it comes to rebutting the attacks on Obama's legislative record, we are the ones we've been waiting for.

Thoughts on Palin's speech

The most striking thing about Palin's speech was that she used such a negative and petty tone in her introduction to the American people. As an Obama supporter, I was starting to worry that the McCain campaign had outsmarted everyone by picking a likable, sympathetic female candidate who would be almost impossible to challenge or attack without running the risk of alienating voters.

But her tone tonight may have insured that she's fair game from here on out. Some of her attacks were ridiculously hypocritical. The most embarrassing example had to be when she made fun of the columns that stood behind Obama during his acceptance speech - from a stage adorned not only with a replica of the Liberty Bell, but also with a massive Jumbotron which alternated between an American flag and images of other famous national landmarks!

There was also her attack on Obama's years as a community organizer (which Giuliani had already made fun of earlier in the night): "I guess a small-town mayor is sort of like a community organizer, except that you have actual responsibilities." This line was a huge crowd pleaser, but it's a strange comparison for her to make. Obama worked as a community organizer between 1985 and 1988 - since then, he has attended law school, worked as a lawyer in Chicago, taught at the University of Chicago Law School, served as an Illinois State Senator for 8 years, and then served as a U.S. Senator for 4 years.

In contrast, Palin was still mayor of Wasilla until December 2006, when she was sworn in as Governor of Alaska. So when she mocked Barack Obama's experience level, she was comparing the job she held just 20 months ago to the job he held 20 years ago!

UPDATED 9/4/08:

The good news is that a lot of people seem to have had the same reaction to Palin's dismissive condescension. The Detroit Free Press asked a voter panel for reactions to the speech, and almost all of the panelists who identified themselves as independents were turned off.

Another thing I wonder about is whether the GOP is underestimating how distant and exotic Alaska seems to people east of the Mississippi, which is where most (but not all) of the major battleground states are. I think most people put Alaska in the same category as Obama's home state of Hawaii - and I think Obama would be a much less credible candidate if he was the junior Senator from Hawaii, rather than Illinois, a heavily-populated state that is home to Chicago, one of the major business capitals in the country. If you're a swing voter in Ohio, Pennsylvania, or Michigan, Chicago is a lot closer to home than Wassila.

I still don't know what to make of the Palin pick, but increasingly, I think it is a deliberate attempt by McCain to distract the electorate from the bigger issues, where the Democrats have an edge this time around. Why would anyone knowingly pick a VP with a four-month old baby and a pregnant unmarried teenage daughter, unless he thinks that the inevitable soap opera coverage would benefit the ticket? On the other hand, after reading this New York Times article, maybe the McCain campaign just botched the whole thing completely:

"They didn’t speak to anyone in the Legislature, they didn’t speak to anyone in the business community," said Lyda Green, the State Senate president, who lives in Wasilla, where Ms. Palin served as mayor.

Representative Gail Phillips, a Republican and former speaker of the State House, said the widespread surprise in Alaska when Ms. Palin was named to the ticket made her wonder how intensively the McCain campaign had vetted her.

"I started calling around and asking, and I have not been able to find one person that was called," Ms. Phillips said. "I called 30 to 40 people, political leaders, business leaders, community leaders. Not one of them had heard. Alaska is a very small community, we know people all over, but I haven’t found anybody who was asked anything."

The current mayor of Wasilla, Dianne M. Keller, said she had not heard of any efforts to look into Ms. Palin’s background. And Randy Ruedrich, the state Republican Party chairman, said he knew nothing of any vetting that had been conducted.

State Senator Hollis French, a Democrat who is directing the ethics investigation, said that no one asked him about the allegations. "I heard not a word, not a single contact," he said.

Andrew Sullivan is right - the story here isn't about Palin, it's about what the pick says about John McCain, especially in contrast with the Obama campaign's cautious, research-intensive vetting process.
