regarding outragedmoderates.org's no-cost distribution of
political committee
reports:
Under Title
11, Part 104.15 of the Code of Federal Regulations, information
from political committee reports may not "be sold or used by any person for the purpose of soliciting
contributions or for any commercial purpose, except that the name
and address of any political committee may be used to solicit
contributions from such committee." 11 CFR 104.15(a) [Legal Information Institute]
There is
an exception to this restriction for the "use of information, which is copied or otherwise obtained
from reports filed under 11 CFR part 104, in newspapers, magazines,
books or other similar communications is permissible as long as the
principal purpose of such communications is not to communicate any
contributor information listed on such reports for the purpose of
soliciting contributions or for other commercial purposes." 11
CFR 104.15(c) [Legal Information Institute]
outragedmoderates.org believes that the
distribution of political committee reports over the internet, at no
cost, is permissive under 11 CFR 104.15(a). The site does not
use information from reports to solicit
contributions, does not charge users any fee in exchange
for information in the reports, and does not accept advertising
revenue or cash donations. Thus, outragedmoderates.org believes that the
free distribution of the reports through
the Download For Democracy campaign should not be deemed as
using the reports for a commercial
purpose.
In the alternative, even if it could be
argued that outragedmoderates.org's use of
information in the reports is commercial in nature, the website
should be protected as part of the "newspapers, magazines,
books or other similar communications" designation, which
is exempted from restrictions under 11 CFR 104.15(c),
as long as the principal purpose of the communication is not
soliciting contributions or other commercial activity.
FEC Advisory Opinion 1986-25 clarifies that the
statute's "other similar communications" clause includes "news
stories, commentaries, and editorials."
[FEC.gov] Political
information websites like outragedmoderates.org should
fall into this category, as they provide a combination of news
and commentary. The Download For
Democracy campaign's principal purpose is to
provide "ways for citizens to access government
documents," and not to use the documents in any form of
commercial activity. Considering the informational nature of
the site, and the Download For Democracy campaign's stated
purpose of providing access to government documents, outragedmoderates.org believes
this use of reports by political committees is permissive under 11
CFR 104.15(c).
